For the avoidance of doubt, all personal expenses (including travel insurance) incurred by the winners in connection with the trip shall be borne solely by the respective winner.

The travel dates of the Travel Package will be decided at Ferrero’s sole discretion in or around January 2026.

4. HOW TO JOIN AND RULES OF ENTRY
參加方法及活動規範
A. Recreate and upload your Hi+Fiv3 Dance video as specified in Section A, Paragraph 3(a).
根據上述A3 條參加方法創作及上傳Hi+Fiv3挑戰活動影片。
B. Please ensure your Instagram/TikTok account is set as “Public” to allow the organiser and Pagaehun to review your dance video.
參加者需確保個人 Instagram 或 TikTok 帳號為公開，以便主辦單位及朴泰勳檢視作品。
C. Each participant can submit multiple videos as long as each entry meets the requirements of these terms and conditions. However, each participant can only win once.
每位參加者可上傳多段活動影片，每次提交作品必須符合本條款及細則要求。同一參加者僅能得獎一次。
D. By uploading your Hi+Fiv3 Dance Challenge video(s) to your Instagram/TikTok account, you confirm that you have read, understood, and accepted this Terms and Conditions and the Privacy Policy available at the website (specified in Section A3 above) and you have agreed and consented that Ferrero and its service providers for this contest may collect, use and process your personal data in connection with this Contest.
透過將您的 Hi+Fiv3 舞蹈挑戰活動影片上載至您的 Instagram 或 TikTok 帳戶，即表示您已閱讀、理解並接受本條款及細則與活動網站(見A3部分)所載的私隱政策，並同意及授權費列羅及其為本次活動提供服務的供應商就本活動收集、使用及處理您的個人資料。
E. The entries submitted must meet the following guidelines:
提交的活動影片必須符合以下指引：
i. Entries must respect the relevant Ferrero/Kinder product, brand and logo.
影片內容必須尊重費列羅/健達的產品、品牌和標識。
ii. Each entry must be suitable for public display and posting.
影片內容必須適合公開展示和張貼。
iii. The entries must not invade the privacy or other rights of any person, firm or entity, including, without limitation, any third party trademarks or copyrights, nor portray Ferrero or Ferrero's brands or products in any way that might tend to subject any of them to public contempt, scandal, disrepute or ridicule.
影片內容不得侵犯任何人士、公司或實體的私隱或其他權利（包括但不限於任何第三方的商標或版權），也不得以可能會使費列羅或費列羅的品牌或產品遭到公眾鄙視、陷入醜聞、聲譽掃地或遭人嘲諷的方式描繪費列羅或費列羅的品牌或產品。
Ferrero reserves the right to disqualify entries submitted that may contain content that is:
費列羅保留取消可能含有以下內容的參賽影片的資格：
iv. defamatory or obscene;
誹謗或淫穢的；
v. fraudulent, deceptive or misleading;
欺詐性、欺騙性或誤導性的；
vi. otherwise offensive or inappropriate; or
具有冒犯性或不適當的；或
vii. not conforming or adhering to the terms and conditions of this Promotion.
不符合或未遵守本推廣活動的條款及細則。
F. Ferrero reserves the right to determine the suitability of the entries in accordance with these terms and conditions at its sole and absolute discretion, and to disqualify any entries it determines to be incomplete, ineligible, or inappropriate.
費列羅保留全權及絕對酌情根據此條款及細則決定參賽作品是否適合及取消其認為不完整、不合資格或不適當的任何影片的參賽資格的權利。
G. Ferrero is not responsible for technical, hardware or software malfunctions, lost or unavailable network connections, undeliverable email, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, telephone, telephone line or other telephone, electronic device or network related problems or errors, whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest, or by any human error which may occur in the processing of the entries in this Contest. If, in the opinion of Ferrero, there is any suspected or actual evidence of tampering with any portion of this Contest, or if technical difficulties compromise the integrity of this Contest, Ferrero reserves the right to determine the suitability of the entries according to these terms and conditions.
對於技術、硬件或軟件故障、網絡連線中斷或不可用、電郵發送失敗，或電子通訊、電話、電話線路故障、錯誤、不準確、不完整、亂碼或延遲，或其他電話、電子裝置或網絡相關問題或錯誤，不論是否由寄件者或與本活動相關或在本活動中使用的任何設備或程式造成，抑或由本活動的處理過程中可能發生的任何人為錯誤造成，費列羅概不負責。 若費列羅認為本活動的任何部分出現疑似或確實被干預的證據，或本活動的公正性因技術困難而受到影響，費列羅保留根據此條款及細則釐定參賽資格之權利。
H. All participants' personal data will be processed in accordance with our company's privacy policy. For more information regarding our company's privacy policy, please refer to https://www.kinder.com/hk/zh/legals. All data collected from participants in this contest will be securely stored and held by the event execution company and will be used for the purpose of prize delivery. The event execution company will delete the participants' data held and stored by them within 3 months after the conclusion of the contest.
所有參加者之個人資料將依據本公司的隱私權政策處理，有關本公司的隱私權政策，請參閱 https://www.kinder.com/hk/zh/legals。參與本活動之所有資料均由活動執行單位妥善保存、持有，並作為獎品寄送依據。活動執行公司將在活動結束後3個月內刪除執行公司保存及持有的參加者資料。
I. Participants have the right to request access to and make changes to their provided personal data. If participants wish to inquire about, view, modify (but not change to another person's data), or request the deletion of their provided personal information, they can do so by sending a written request via email to privacy.apac@ferrero.com.
參加者有權要求查閱及更改其所提供的個人資料。如參加者需查詢、查看、修改 (但不可更改為他人資料) 或請求刪除已提供的個人資訊，請以書面方式電郵至 privacy.apac@ferrero.com.
5. WINNER SELECTION AND PRIZE COLLECTION
評選方式及領獎
A. Selection of winner will be done by Pagaehun based on the best dance at the end of this Contest. The decision is final and no appeals will be entertained.
活動得獎者將由朴泰勳在本次活動結束後進行評審選出最佳作品。其評選結果為最終之決定，不受理任何人以任何形式之上訴。
B. The winner will be announced on the date as specified in Section A3 via the website.
得獎名單將於A3條中指定的日期在網站上公佈。
C. The winner will be informed by way of Instagram/ TikTok messages within five (5) working days from the date of announcement. The winner is required to acknowledge, complete and submit to Ferrero via email a digital claim form and supporting documents requested. Only upon submission of the claim form and documents requested, the prize will be released to the winner.
活動執行單位將於得獎名單公佈5個工作天內，透過 Instagram 或 TikTok 私訊通知。得獎者須透過電子郵件向費列羅提交一份已填妥的領獎表格及其他所需文件。得獎者必須在領取獎品前，提交領獎表格及所需文件。
D. If the winner cannot be contacted or fails to provide the required details/ claim forms within 10 (ten) working days from the date of request, he/she will be deemed to have relinquished the prize and Ferrero reserves the right at its sole discretion to select and reallocate the prize to another winner.
如在獲獎通知發出10個工作天後仍無法聯繫到得獎者，或得獎者未能按指示於10個工作天後內交回任何相關文件，得獎者即視為放棄得獎資格，費列羅有權取消其得獎資格，並由候補得奬者補上。
E. Ferrero will not be responsible for any redemption that has exceeded the validity period as mentioned in the winner notification email.
費列羅不對任何超過得獎確認電郵所述之有效期的兌獎負責。
F. Winners shall be responsible for any (if any) additional costs, duties, taxes and/or other incidental expenses which may be incurred as a result of and/or related to the winners’ claiming and/or acceptance of the prize.
如因領取及/或接受獎品而可能招致或與此有關的任何額外費用、稅費、稅項及/或其他附帶開支（如有），應由得獎者自行承擔。
G. No substitution or transfer of prize shall be permitted.
所有獎品不得替換或轉讓。
H. The outcome of the selection of winners is final and no correspondences will be entertained.
得獎結果具有終局性，恕不受理任何異議。
I. During the contest, if any registered data of participants or winners or any winner notification or redemption details given by Ferrero is delayed, lost, inaccurate, unidentifiable or damaged caused by any computer, network, telephone, technical or other issue not attributed to the default of Ferrero, Ferrero shall not be liable and no participant or winner can raise any objection.
本活動期間如有任何因電腦、網路、電話、技術或其他不可歸責於費列羅之事由，而使參加者或得獎者所登記之資料或費列羅發出之得獎通知或領獎詳情有延遲、遺失、錯誤、無法辨識或損毀，導致資料無效之情況，費列羅不負任何法律責任，參加者或得獎者均不得異議。
J. If winners cannot receive any winner notification or redemption details or cannot redeem the prize due to any untrue or incorrect information submitted by participants, Ferrero shall bear no responsibility. This contest only accepts Hong Kong mobile phone number with traditional voice and SMS function provided by Hong Kong mobile network operators. Winners will be disqualified if their mobile phone numbers do not carry the voice or the SMS function or their registered phone numbers are not in use, are invalid or have been changed at the time of prize collection.
若參加者所填寫之資料不實或不正確，導致得獎者無法收到得獎通知、領獎詳情或獎品，費列羅恕不負責。本活動只接受具有由香港流動電話網絡供應商提供的傳統語音功能的香港手提電話號碼登記，如得獎者的手提電話號碼沒有上述的語音功能或於領獎時登記電話號碼已停止服務、無效或已更改，其得獎資格將被取消。
6. OTHER LEGAL TERMS AND CONSIDERATIONS
其他法律條款及考慮
A. In consideration of a participant's submission being reviewed and evaluated for this Promotion, each participant hereby grants to Ferrero and/or its affiliates a non-exclusive, perpetual, irrevocable, fully paid, royalty-free, worldwide license to use, copy, sublicense, subcontract, transmit, distribute, publicly perform, publish, edit, delete or display such submission, or any portion thereof, in any media now known or hereafter devised including, but not limited to, all forms of television and all forms of internet and wireless protocol without any need of approval from the participant. Each participant authorizes Ferrero and/or its affiliates, including the right to authorize third parties including but not limited to partners and promotion agencies, to utilize the submission submitted to Ferrero and to make derivative works from such material in any manner they see fit. Each participant agrees that such derivative works and proceeds of any use of such participant’s submission shall become the property of Ferrero and/or its affiliates, and shall be freely assignable by Ferrero and/or its affiliates and that Ferrero and/or its affiliates shall have no obligations whatsoever to the participant.
以本推廣活動審評參與者提交的作品為代價，在無需徵求參與者的批准下，各參與者謹此向費列羅及/或其關聯公司授予非專屬、永久、不可撤銷、完全付訖、免版稅、全球性許可，以在現時已知或日後產生的媒體（包括但不限於所有形式的電視和所有形式的互聯網和無線通訊協定）中使用、複製、分許可、分包、傳輸、分發、公開表演、發表、編輯、刪除或顯示提交的作品或其中任何部分的內容。各參與者授權費列羅及/或其關聯公司（包括授權第三方（包括但不限於合夥人和推廣機構）的權利）使用提交給費列羅的作品並以其認為適當的任何方式使用該等素材創作衍生作品。各參與者同意，使用其提交的作品產生的衍生作品及所得收益歸費列羅及/或其關聯公司所有，並可由費列羅及/或其關聯公司自由轉讓，且費列羅及/或其關聯公司不對參與者負有任何責任。
B. By participating in this Contest, participants agree to abide by and be bound by these terms and conditions of participation and the outcome of the selection of winners by Ferrero. Failure to comply with the said terms, conditions, rules, regulations, instructions or methods will result in a participant’s disqualification.
參與本活動，即代表參與者同意遵守本參與條款及細則以及費列羅的抽獎結果並受此約束。未能遵守該等條款、條件、規則、規章、指示或方式將導致參與者被取消資格。
C. Each participant will not hold Ferrero and/or its affiliates, partners and contest agencies responsible for any claims or liabilities (now known or hereafter arising). Ferrero and/or its affiliates, partners and contest agencies have the right to seek indemnification from each participant in respect of all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs and all other professional costs and expenses) suffered or incurred by Ferrero and/or its affiliates, partners and contest agencies arising through the use of participants’ information.
各參與者應免除費列羅及/或其關聯公司、合夥人和推廣機構的任何及所有申索或責任（現時已知或日後產生）並使之免受相關損害，且費列羅及/或其關聯公司、合夥人和推廣機構有權就費列羅及/或其關聯公司、合夥人和推廣機構因使用該參與者提交的資料而蒙受或招致的所有責任、費用、開支、損害賠償及損失（包括任何直接、間接或相應而生的損失、利潤損失、聲譽損失以及所有利息、罰款及訟費及所有其他專業費用及開支）向各參與者尋求賠償。
D. In the event of force majeure, including but not limited to heavy rainstorm, typhoons, earthquakes, floods, wildfires, avalanches, power outages, flight or airport incidents, war, terrorist attacks strikes, or other unforeseen, unavoidable and uncontrollable events, or if Ferrero and/or its affiliates, partners and contest agencies deem that this Contest or the Travel Package cannot be carried out safely, Ferrero reserve the right to cancel, terminate or suspend the event.
如因不可抗力事件，包括但不限於豪雨特報、颱風、地震、水災、森林火災、雪崩、停電、航班或機場事故、戰爭、恐怖攻擊、罷工或其他無法預見、避免或克服之事件，或經費列羅及/或其關聯公司、合夥人和推廣機構基於安全考量認定活動或旅行體驗無法如期進行時，費列羅有權取消、終止、或暫停本活動或活動獎品。
E. Ferrero shall not be liable for any loss suffered by participants or winners in connection with any claim arising from the prizes, and/or any loss, damage or personal injury arising from this Contest and/or the use of the prizes. No replacement of prize or compensation will be made by Ferrero if the prize is lost, damaged or stolen after redemption by the winners.
費列羅不會因參加者或得獎者就獎品之申索而招致的損失或與本活動及 / 或就使用獎品相關的任何損失、損害或人身傷害負上任何責任。得獎者領取獎品後，若有遺失、損壞或被竊，費列羅將不會補發獎品，亦不會作出任何補償。
F. In no event shall Ferrero and/or its affiliates be liable to the participants for any monetary amount greater than the value of the prizes due to the prize winner under the rules and regulations of this Contest.
在任何情況下，費列羅及/或其關聯公司對參與者承擔責任的金額概不超過得獎者根據本活動的規則和規章獲得的獎品的價值。
G. Ferrero and/or its affiliates shall not be liable to the participants in contract, tort or negligence or otherwise for any loss, damage, costs or expense of any nature whatsoever incurred or suffered by the participant and which is of indirect or inconsequential nature, including without limitation any economic loss or other loss.
對於參與者招致或蒙受以及間接或非相應而生的任何損失、損害賠償、費用或開支，包括但不限於任何經濟損失或其他損失，費列羅及/或其關聯公司不在合約法、侵權法或疏忽或其他方面對參與者承擔任何責任。
H. In case of disputes, Ferrero reserves the rights of final decision.
如有任何爭議，費列羅將保留最終決定權。
I. If there is any discrepancy or inconsistency between the English and Chinese version of these terms and conditions, the English version shall prevail.
如本條款及細則的中英文本有任何歧義或不一致，概以英文本為准。
7. PRIVACY POLICY
私隱政策
By participating in this Contest, participants agree and consent to allow his/ her personal data being collected, processed and used by Ferrero and/or its affiliates, partners and contest agencies for the purpose of this Contest and in accordance with Ferrero’s Privacy Policy which may be viewed at https://www.kinder.com/hk/zh/legals .
透過參與本活動，即代表參與者同意允許費列羅及/或其關聯公司、合夥人及推廣機構為本活動及根據費列羅的私隱政策（請見https://www.kinder.com/hk/zh/legals）收集、處理和使用其個人資料。
We respect your privacy and are committed to ensuring the security of your personal data. Any collection of personal data will be used solely for the management and operational needs of this Contest.
我們尊重您的隱私，並致力確保您個人資料的安全。任何個人資料的蒐集，將僅用於是次活動的管理及操作需要。
Ferrero and/or its affiliates, subsidiaries, partners and contest agencies will collect each participant’s personal information for the purpose of administering the Contest, including notifying and verifying successful participants, and the list of winners (their Instagram/TikTok account names) will be announced on the date as specified in Section A3. Personal information may be disclosed to authorized third parties in administration of this Contest on behalf of Ferrero and/or its affiliates, subsidiaries, partners and Contest agencies.
費列羅及/或其關聯公司、附屬公司、合夥人和推廣機構將收集各參與者的個人資料，以
執行本活動，包括通知及核實成功的參與者，得獎名單(包括得獎者Instagram 或 TikTok 帳號名稱)將會於指定日期公佈(見A3部分)。個人資料可披露給代表費列羅及/或其關聯公司、附屬公司、合夥人和推廣機構執行本活動的授權第三方。
Any information and/or personal data which the participant will provide, or which is otherwise gathered in the context of this Contest, will be used by Ferrero and/or its affiliates, partners and contest agencies in compliance with the applicable legislation. This means, in particular, that any Personal Data processing carried out by Ferrero and/or its affiliates, partners and contest agencies will respect the principles of lawfulness, fairness, transparency, purpose limitation, storage limitation, data minimization, accuracy, integrity and confidentiality.
費列羅及/或其關聯公司、合夥人和推廣機構將根據適用法例使用參與者提供或本活動另行收集的任何資料及/或個人資料。具體而言，費列羅及/或其關聯公司、合夥人和推廣機構將根據合法性、公正性、透明性、用途限制、儲存限制、資料最少收集、準確性、誠信及保密原則處理任何個人資料。

8. GOVERNING LAW
管轄法律
This Contest shall in all respects be governed by the laws of the country/region as specified in Section A3. However, it shall be the participant’s sole responsibility and obligation to ensure that he/she complies with and does not contravene any laws to which he/she may be personally subjected to.
本活動在所有方面均受 A3 條中指定的國家/地區的法律約束。但參與者應有責任和義務自行確保自己遵守及不違反規限其個人的任何法律。
